Swiggy has moved to court against the Competition Commission of India’s (CCI) decision to disclose confidential information to the National Restaurant Association of India (NRAI).

What Happened: According to a report by Bar and Bench, Swiggy has lodged a petition in the Karnataka High Court, contesting the CCI’s decision taken on April 24. The CCI had given NRAI representatives access to confidential details about Swiggy, which were revealed during an investigation into allegations of anti-competitive practices by Swiggy and Zomato.

Swiggy’s petition argues that the CCI’s decision to grant NRAI access to such sensitive business information was arbitrary, unreasoned, against the Competition Act, and could cause irreparable harm to Swiggy. The case was briefly heard by Justice MGS Kamal, who questioned the jurisdiction of the Karnataka High Court to hear the plea since the case was initially handled by the CCI in Delhi.

Senior Advocate Sajan Poovayya, representing Swiggy, argued that the Karnataka High Court does have jurisdiction to hear the case, as the CCI is a national body and Swiggy’s registered office is in Bengaluru. The case is set for further hearing on the question of jurisdiction on May 23.

The conflict began with a complaint filed by NRAI in 2021, accusing Swiggy and Zomato of engaging in various anti-competitive practices. In response to the allegations, Swiggy had submitted highly confidential information to the CCI’s Director General (Investigation) between September 2022 and October 2023.

Swiggy is now urging the High Court to set aside the CCI’s April 24 order, arguing that giving NRAI access to Swiggy's confidential information would be against the CCI’s own practices and could cause irreparable injury to Swiggy.
