The Delhi High Court has directed food delivery platforms Swiggy and Zomato to delist 13 restaurants for infringing on Domino’s Pizza’s trademark.

What Happened: These restaurants, operating under names like "Dominic Pizza," "Dominek's Pizza," and "Domnick Pizza," were said to be using similar names to Domino’s and selling food items on both platforms.

Justice Anish Dayal issued an ex parte ad interim order, requiring Swiggy and Zomato to remove links to these eateries within a week. The Court also restrained the restaurants from using names or trademarks similar to Domino’s.

This injunction will come into effect on June 1, 2024, to give the defendant restaurants time to change their names.

What To Know: Domino’s filed a lawsuit for trademark infringement, arguing that these outlets exploited similar trademarks to deceive customers into believing they were associated with the brand.

Domino’s advocate highlighted that the search results often misled customers by showing these outlets when they typed the initial letters of Domino’s name, such as ‘DOM,' ‘DOMI,' and ‘DOMINO.'

The Court agreed with Domino’s argument and determined that the company had made a valid case for an interim order. Justice Dayal’s ruling directs Swiggy and Zomato to comply and notify the affected restaurants if necessary.
